Terms & Conditions of Sale

Article 1 — Purpose and scope

These Terms and Conditions of Sale govern the sale of collectibles and antiques by Le Cabinet d'Arts et Objets Insolites (hereinafter "Insolite Luxe") through the website insoliteluxe.com (hereinafter "the Website").

Any order placed on the Website implies unconditional acceptance of these Terms by the buyer.

Article 2 — Products

Products offered are antique collectibles (vesta cases, cigar cutters, knives, cases, pill boxes, snuff boxes, etc.). Each item is unique and sold as-is, with imperfections inherent to its age and historical use.

Photographs and descriptions are as accurate as possible. However, slight variations may exist between photos and the actual object. Buyers are encouraged to contact us before ordering if in doubt.

Article 3 — Prices

Prices are listed in euros (EUR) inclusive of all taxes. The margin scheme VAT applies in accordance with Article 297 A of the French General Tax Code for second-hand goods.

Shipping costs are not included in the displayed price and are calculated individually based on weight, dimensions and destination. They are communicated to the buyer by email after order confirmation.

Article 4 — Orders

An order is only final upon email confirmation from Insolite Luxe. We reserve the right to refuse any order for legitimate reasons.

As each item is unique, it is sold subject to availability. In case of unavailability after ordering, the buyer will be notified and fully refunded.

Article 5 — Payment

Payment is made online by credit card (Visa, Mastercard, American Express) through the secure Stripe platform, or by PayPal.

Payment is due at the time of order. Shipping costs are invoiced separately after quotation.

Article 6 — Delivery

Items are carefully shipped, packaged appropriately for their fragility and value. Delivery is made by tracked and insured carrier.

Delivery times are provided for information only and do not constitute a contractual commitment. Insolite Luxe cannot be held responsible for delays attributable to the carrier.

The buyer must check the condition of the package upon receipt and report any anomaly within 48 hours.

Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the buyer has 14 days from receipt of the item to exercise their right of withdrawal, without having to justify reasons or pay penalties.

The item must be returned in its original condition and packaging. Return shipping costs are borne by the buyer. Refund will be made within 14 days of receiving the return.

Article 8 — Warranties

Items sold are antiques and vintage collectibles. As such, they benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Normal wear and marks of time inherent to antique items do not constitute a defect of conformity.

Article 9 — Liability

Insolite Luxe endeavours to describe items with the greatest accuracy. Nevertheless, dates, attributions and provenances are given in good faith and for information purposes, in accordance with the practices of the art and antiques market.

Article 10 — Intellectual property

All elements of the Website (texts, photographs, logos, layout) are protected by intellectual property law. Any reproduction or use without prior written authorisation is prohibited.

Article 11 — Personal data

Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR). It is used solely for order processing and customer relations.

Article 12 — Disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action.

In accordance with the provisions of the French Consumer Code, the buyer may use the consumer mediation service free of charge. The competent mediator will be communicated upon request.
